Terms of Service

These Terms of Service (“Terms”) govern your use of Fieldmark(the “Service”), operated by The Purple Ohm(ACN 698 440 943) (“we”, “us”). By creating an account or using the Service, you agree to these Terms. If you are using the Service on behalf of an organisation, you agree to these Terms on its behalf.
1. The Service
Fieldmark is a research-synthesis platform for capturing observations and cross-referencing them into evidence- backed personas. We may add, change, or remove features over time.
2. Accounts
You must provide accurate information and keep your login credentials secure. You are responsible for activity that occurs under your account and for the conduct of members you invite to your workspace. You must be at least 16 years old to use the Service.
3. Plans, billing, and cancellation
- The Service offers a Free plan with usage limits and a paid Pro plan.
- Pro is billed at AUD $50 per workspace per month (GST inclusive), charged in advance through Stripe. Pricing may change with notice for future billing periods.
- Subscriptions renew automatically each month until cancelled. You can cancel at any time from your workspace settings; cancellation takes effect at the end of the current billing period.
- Except where required by law, payments are non-refundable for partial periods.
4. Your content
You retain all rights to the data and content you put into the Service (“Your Content”). You grant us a limited licence to host, store, process, and transmit Your Content solely to operate and provide the Service to you. You are responsible for Your Content and for having the right to use it, including any personal information about third parties that you enter.
5. Bring-your-own keys and third-party services
Some features rely on credentials you supply (for example, an AI provider API key or an Azure DevOps token) and on third-party services. When you use those features, your data is sent to those third parties under their own terms, and you are responsible for your use of, and any charges from, those providers. We are not responsible for third-party services.
6. Acceptable use
You agree not to:
- use the Service unlawfully or to store unlawful content;
- attempt to access other workspaces’ data or breach our security;
- disrupt or overload the Service, or reverse engineer it except as permitted by law;
- resell or provide the Service to third parties except your own workspace members.
7. Availability
We aim to keep the Service available but provide it on an “as is” and “as available” basis. We may perform maintenance, and features may occasionally be unavailable.
8. Warranties and liability
Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy under the Australian Consumer Law that cannot lawfully be excluded. Subject to that, to the maximum extent permitted by law: the Service is provided without other warranties; and our total liability arising out of or in connection with the Service is limited, at our option, to re-supplying the Service or refunding the fees you paid for the Service in the three months before the claim.
9. Termination
You may stop using the Service and close your account at any time. We may suspend or terminate access if you breach these Terms or to comply with law. On termination, your right to use the Service ends; provisions that by their nature should survive will survive.
10. Governing law
These Terms are governed by the laws of the Australian Capital Territory and the Commonwealth of Australia, and you submit to the exclusive jurisdiction of the courts of the Australian Capital Territory.
11. Changes to these Terms
We may update these Terms from time to time. We will update the “last updated” date above and, where changes are material, take reasonable steps to notify you. Continued use after changes take effect means you accept the updated Terms.
